FULL DIVING BOAT CHARTER TERMS AND CONDITIONS

In addition to our published cruise program, Sea Safari boats can be chartered to accommodate the route or itinerary of your preferences. However charter must confirm to the existing Sea Safari programs departure and arrival dates and ports. Charter request must be made by confirmed booking 90 days in advance.

A minimum of 8 days of charters is required if the sailing is outside Bali.

Number of Passenger

The maximum number of passenger is varied as follow:

Sea Safari III	:	Maximum of 22 persons
Sea Safari Cheng Ho	:	Maximum of 30 persons
Sea Safari VI	:	Maximum of 20 persons
Sea Safari VII	:	Maximum of 28 persons
Sea Safari 8	:	Maximum of 26 persons
Sea Safari 9	:	Maximum of 36 persons

Facilities and Services onboard

• Deck state cabin located on the middle and upper deck with a sea-view
• Deluxe cabin located on the lower deck
• Air- conditioned cabins with private bathroom (hot and cold showers)
• A tray of toiletries in each cabin
• Dining room and Bar
• 24 hours tea and coffee making facilities
• Vegetarian food available on request
• Easy access swim/boarding platform
• Fresh water on deck shower
• Complete scuba dive equipment
• TV, Karaoke & DVD entertainment units
• Computer with Adobe Photoshop application
• Laundry service
• On Board telecommunication

These rates included:

• Accommodation onboard & meals (breakfast, lunch, dinner)
• Tea/coffee, bottled water, tea-time snacks
• Cruise Accident Insurance
• English speaking Certified Dive Master
• Regular air fills, tank, weight belt, compressor bauwer
• Harbor and anchor fee
• Government tax

These rates excluded:

• International/domestic airfare and airport tax
• Soft drinks and alcohol beverages
• Cruise director
• Land tour and entrance fee
• Personal travel Insurance
• Gratuities to guide and crew
• Onboard telecommunication
• Laundry service
• Passengers may bring onboard own beverages, however will apply USD 5/bottle corkage fee
• Pick up service Bali area USD 10/pax and outside Bali USD 20/pax (one way)
• Mobilization and demobilization (empty run) rate is applied if sailing started outside Bali water as the boat HOMEBASE

Reservation

All reservation must be made by electronic mail or facsimile and must state your agent, the cruise period, full name, date of birth, nationality, passport number, and any special requirements. The charter price may be changed without notification if no down payment/deposit is received within 7 days, after we issue the invoice

Deposit

A deposit of 25% must be sent to Sea Safari Cruises bank account within 7 days after the date the reservation is made. If the deposit is not received within the stated period of time then Sea Safari Cruises will automatically offer the berths to other travel and booking agents.

Mobilization /Demobilization

If the charter is booked to sail outside the schedule cruises itinerary or to another area then the following terms are applicable. Mobilization /demobilization fee will be added to the total cost of the cruise depending on location. The price of this fee will depend on the location of the charter and will be given to client prior to the due date of the deposit.

Balance Payment

Balance payment is to be paid in full at least 45 days prior departure date. If full payment of the balance is not received by this date then Sea Safari Cruises can cancel the booking and enforce cancellation fee.

Short Notice Booking

Full payment must be made at the time of booking if the reservation is made less than 60 days prior to departure.

Late Payment Penalty Policy

For payment received after due date, the outstanding balance will automatically incur a penalty of 5%.

Cancellation Policy:

The following cancellation penalties apply unless amended by agreed local conditions:

46 – 60 days	:	25% of the total fare
31 – 45 days	:	75% of total fare
0 – 30 days	:	100% of total fare

Schedule and Itineraries

• All schedule cruises can be booked as full-boats charters.
• There are certain changes to the scheduled itineraries allowed by chartering customer subject to prior arrangement and approval by Sea Safari Cruises.
• Itineraries are subject to change due to sea and weather condition, availability of sea anchorage, government regulations and other factors.

Diving

Only certified divers able to produce a certification card and demonstrate diving competency, will be permitted to participate in scuba diving. All divers will be required to sign a liability release form..

Force Majeure and Unpredictable Acts of Man

Sea Safari Cruises reserves the right to cancel a trip for reasons of Force Majeure (i.e. natural disaster, epidemic etc) or unavoidable acts of man (i.e. war, riots, strikes etc). In the even of this happening Sea Safari Cruises will advice you at the earliest possible date.

Damages Resulting From Personal Injury, Illness or Death

Sea Safari Cruises assumes no liability due to any cause whatsoever whether caused by failure or delay or other irregularity, acts or omissions occurring during a trip under which the means of transportation or other service provided thereby is offered or supplied by owners, operators or public carriers for and on behalf of Sea Safari Cruises.

Sea Safari Cruises shall not be responsible for any injury to person (whether or not resulting in death) or damage to property arising out of any act of war, insurrection, revolt or any other civil uprising or military action occurring in the countries of origin, destination or passage.

In case of a medical problem arising during the voyage, either onboard or on shore, which results in costs for evacuation, use of aircraft or repatriation, the responsibility for payment of these costs belongs solely to the passengers.

Loss or Damage to Personal Belongings

Sea Safari Cruises does not take any responsibility for loss or damage to guest’s personal belongings that are due to Force Majeure causes.

Entrance Fee to National Park

Most bio-diverse marine areas in the world has been declared a National Park effective August 12, 2007. All divers are now required by the government regulation to pay an entrance of US$55 per person to dive in this area. The ticket will be valid of one year and will go towards supporting reef conservation and community development. This project will be managed by three major NGOs, Coral International (www.coral.org), WWF (www.wwf.org) and TNC (www.nature.org).

Sea Safari Cruises will pre-purchase the ticket for you and bill it to your account on board.

General and Other Conditions

• Sea Safari Cruises reserves the right to substitute a vessel of similar standards when operational requirements demand.
• Itineraries are subject to change due to sea and weather conditions, availability of sea anchorage, government regulations and other factors.
• This contract is a CONFIDENTIAL agreement represented by the signatures attached and as such may not be communicated in any form, written or verbal, to third parties.
• Any amendments and additions to the present contract shall be valid only when they are made in written form and duly signed by both parties.
• This contract has no validity unless duly signed and returned to us as an acceptance of all rates and conditions
• In any condition like economic situation of Indonesia especially for the significant increase of fuel, taxes, currency fluctuation and any other related factors, Sea Safari Cruises reserve the right increase the price even after the contract has been drawn.
